54. Jacob FOUTS Sr
was born about 1786 in Swearing Creek Waters, Rowan County, North Carolina.
He died on 14 Jul 1852 in Macon County, North Carolina.96
Jacob Fouts' Estate records include a Petition dated May 1854 by widow Mary M.
Baker requesting partition of the estate, and naming the heirs. He was buried
in Jul 1852 in Fouts Cemetery, Macon County, North Carolina.97

Jacob Fouts and Joseph Fouts were both listed on the 1815 tax list for Ashe County.
Jacob was listed with no land, and with one poll (taxable adult male, being himself).
He was in the same district with Andrew Shearer and Jacob Baker (his father-in-law),
in fact it was "Captain Bakers District". By 1834, the Fouts
began a migration south to Macon County, North Carolina settling on Iotla Creek
and Burningtown Creek. Jacob and his sons and his married daughters and their
families all made the move, and Jacobs widowed mother seems to have moved
with them. Brother Joseph remained in Ashe County. On 7 Mar 1836, Michael Waters
sold Jacob Fouts 140 acres on Iotla Creek in Macon County, North Carolina. James
Fouts (son) and George Rowland (son-in-law) witnessed the deed. On 11 Sep 1852,
Jacob Fouts Sr sold 55 acres to David Younce, for $100. Witnessed by Joseph Rowland
and James Fouts.
Jacob FOUTS Sr and Mary Margaret BAKER were married in North Carolina. 55. Mary Margaret BAKER was born about 1789/90 in Rowan
County, North Carolina. She died on 3 Jun 1858 in Macon County, North
Carolina.96
Margaret Fouts' Estate was dated 14 Sep 1858 when James Fouts and John Fouts
were named administrators.
She was buried in Jun 1858 in Fouts Cemetery, Macon County, North Carolina.98

It is noted that their tombstones look new and were probably placed sometime
in the mid 20th century or later.

in Ashe County, North Carolina. Mary married George Rowland before
1829 in Ashe County (no marriage record found). George was a son of Joseph Rowland
and Elizabeth Fouts. By 1834 the Rowlands and Fouts and other Ashe County families
moved to Macon County, North Carolina. George Rowland was listed on the 1840
census just a few houses from his parents. | | ii. | James D. FOUTS was born on 10 Aug 1810 in Wilkes County,
North Carolina. He owned 2 slaves: a 55 year old male and a 19 year
old female in 1860 in Macon County, North Carolina.53

Ashe County, North Carolina. She died in 1900 in Macon County, North
Carolina. She was buried in 1900 in Aquone Baptist Cemetery, Aquone,
Macon County, North Carolina.60
On 20 Mar 1838 Rebecca married Michael J. Waters in Macon County, NC. Michael
J. Waters died 1846 in Macon Co, NC. Rebecca married second to Reuben P. Evans
in 1849. Reuben was a first cousin to her first husband, a son of Zachariah Evans
and Mary Waters. They are both buried at Aquone Cemetery in Macon County. | | viii. | Charlotte FOUTS
was born in 1824/25 in Ashe County, North Carolina. She died between
1854 and 1860 in Macon County, North Carolina. She married George
Clampett just before 1840 in Macon County. He was a brother to Richard Clampett
who married Charlotte's sister. | | ix. | Susan FOUTS was born on 11 Sep 1826 in Ashe County, North
Carolina. She died on 18 Nov 1904 in North Carolina.
She was buried in Burningtown Baptisit Church Cemetery, North Carolina.
Susan Fouts married David Younce on 20 Feb 1849 in Macon Co, NC. | | x. | Jacob FOUTS Jr
was born on 25 Jan 1830 in Ashe County, North Carolina. He served
in the military. For the Civil War, Jacob Fouts (and brother John)
enlisted as a Private in Company A, 7th Battalion, North Carolina Cavalry. He
enlisted on 7 Jul 1862 as a resident of Macon County, aged 33. On 3 Aug 1863
he was transferred to Company E, 65th Regiment North Carolina Troops. He and
John were captured at Jacksboro, Tennessee on 27 Aug 1863 and confined at Camp
Chase, Ohio. He was transferred to Rock Island, Illinois on 22 Jan 1864. He was
released after taking the oath of allegiance on 16 Jun 1865 Jacob Fouts married
Sarah Ellen Younce on 22 Sep 1853 in Macon Co, NC. She was a sister to David
Younce who married Jacob's sister Susan Fouts, a daughter of Andrew Younce. By
1868, Jacob and family moved over to Polk County, Tennessee where his sister
Nellie Fouts Waters had been living. They were listed there on the 1870 census.
At some point they moved to Oklahoma. | | xi. | John H. FOUTS was born on 18 Dec 1833 in Ashe County,
North Carolina. He died on 18 Sep 1907 in Macon County, North Carolina.
He served in the military.
For the Civil War, John Fouts (and brother Jacob) enlisted as a Private in Company
A, 7th Battalion, North Carolina Cavalry. He enlisted on 7 Jul 1862 as a resident
of Macon County, aged 30. On 3 Aug 1863 he was transferred to Company E, 65th
Regiment North Carolina Troops. He and brother Jacob were captured at Jacksboro,
Tennessee on 27 Aug 1863 and confined at Camp Chase, Ohio. He was transferred
to Rock Island, Illinois on 24 Jan 1864. He was imprisoned with his brother Jacob
Fouts. His Civil War record does not show when he was released.
He was buried in Fouts Cemetery, Macon County, North Carolina.98
